SHANE DUNCAN NOTARIAL SERVICES – TERMS OF SERVICE

1. Acceptance of Terms

 

      • Agree to Comply. By requesting and utilizing services from Shane Duncan Notarial Services Enterprise LLC, doing business as Shane Duncan Notarial Services (the “Company,” or “Company’s”), you, the Client (the “Client,” “Clients,“Signer,“Signers,“Witness,“Witnesses,“Entity, or “Entities”), agree to comply with and be bound by these Terms of Service (“Terms”). These Terms outline the rules and regulations for the use of the Company’s notarization services and other services, and establish a legally binding contract between you and the Company. If you do not agree with these Terms, please do not use the Company’s services.

2. Company Ownership Disclosure

 

      • Company Representative. The Company would like you, the Client, to know that Shane Duncan (the “Founder,” “Owner,” “Chief Executive Officer,” “Representative, and “Authorized Representative whose pronouns are “he, and “him”) is the Founder, Owner, Chief Executive Officer (CEO), Representative, and the Authorized Representative of Shane Duncan Notarial Services. The Company would also like you to know that Shane Duncan, at the time of these Terms of Service, is the only Representative of the Company and that Shane Duncan will be the duly commissioned Notary Public (also called a Notarial Officer) authorized by the State of New Jersey and the State of New York to take, conceal, and record your identity information, as well as other information pertaining to you, and to protect said information and may send said infomation to other parties authorized by local, state, and or federal law, and or to other Entities, with whom the Company deals.

3. Scope of Services

 

      • Primary Company Duties. Shane Duncan Notarial Services offers notarization services as authorized by the State of New Jersey and the State of New York. The Company’s notarization services may include but are not limited to document notarization, the taking of an acknowledgment(s), the talking of a verification on oath(s), the taking of a verification of affirmation(s), the taking of a jurat(s), administrating an oath(s), witnessing a signature(s), attesting a signature(s), certifying a copy of a record(s), and other related services as permitted by state and federal law. The Company’s notarization services are limited to the acts authorized by the states in which it operates.
      • Secondary Company Duties. Other services offered by the Company may include and are not limited to loan/mortgage signing services, real estate signing services, general notarization services, document apostille services, document authentication services, I9 services, document courier services, business registration services, fingerprinting services, document printing services, document scanning services, passport photo services, and more.
      • Company Duties Not Performed. Shane Duncan of Shane Duncan Notarial Services is not an attorney licensed to practice law and may not give legal advice about immigration or any other legal matter. Fees will not be accepted for an interest in legal advice, nor will legal advice be given in exchange for a fee. Please consult with an attorney for legal advice about your document(s) and for additional matters concerning said document(s) before scheduling an appointment.

4. Client Responsibility

 

      • Identification Requirements. All Clients, Signers, Witnesses, and Entities providing their Clients, Signers, and Witnesses to the Company and its representatives must present at least one (1) valid, government-issued identification in accordance with applicable state laws and or federal laws. The government-issued identification presented must be a current identification or an identification that has not expired more than three (3) years from its expiration date. The Company may recommend you present two (2) forms of government-issued identifications before, during, or after your appointment meeting in case of any discrepancies with your identification. You, the Client, Signer, Witness, and Enity, must adhere to this policy. The Company may also recommend you present a credible identifying Witness who is at least eighteen (18) years of age with a government-issued identification, upon fulfilling the aforementioned requirements above, to testify on your behalf that you are who you say you are. The Company hereby reserves the right to refuse service if acceptable identification is not provided.
      • Accuracy of Information. You are responsible for ensuring that all information provided to the Company is true, accurate, and complete. Shane Duncan Notarial Services shall not be liable for any losses or issues that arise from inaccuracies in the information provided by you, the Client.
      • Document Preparation. It is your responsibility to print out all your document(s) requiring notarization before your scheduled appointment meeting. There are times when the Company may not be able to print document(s) for you. Thus, the Company shall not be liable for any documents that have not been printed out on your behalf.
      • Document Review. It is your responsibility to review your document(s) thoroughly before your notarization appointment meeting. The Company will not review the contents of your document(s) for legality or validity, as the Company and all representatives of the Company are not authorized to provide legal advice or interpretation. Therefore, it shall be your responsibility to seek out legal counsel for your document(s).

5. Appointment Policy

 

      • Walk-in Notice. Walk-ins to the Company business locations are not allowed unless announced under the “ANNOUNCEMENTS section at shaneduncannotarialservices.com (the “Company Website”). Therefore, it is imperative that you schedule an appointment before coming in at any of the business address locations. As of today’s date, walk-ins are not allowed at the New Jersey business location at 299 Glenwood Avenue, Suite 201, Bloomfield, NJ 07003, and at the New York business location at 285 Fulton Street, Floor 85, New York, NY 10007. As of today, walk-ins are also not allowed at any other location listed on the Company Website.
      • Appointment Scheduling. Appointments must be scheduled three (3) hours in advance, either through the Company Website, by phone at (862) 944-8507 for the New Jersey locations, by phone at (862) 409-4891 for the New York locations, by phone at (201) 268-5604 for all locations, or through email at shaneduncannotarialservices@gmail.com (“Company Email”) for all Company locations. There are cases where the Company may allow appointments to be scheduled less than three (3) hours in advance. This accommodation may be accommodated at the Company’s discretion, depending on schedule availability. You can check the Company’s availability by going to the “Contact Me page of the Company Website and viewing the current calendar.
      • Cancellations and Rescheduling. You, the Client, must provide at least twelve (12) hours advance notice for any cancellation or rescheduling of appointments. Cancellations made within less than twelve (12) hours’ notice do not incur a cancellation fee.
      • Late Arrivals. You, the Client, are expected to arrive on time for your scheduled appointment meeting. If you are more than fifteen (15) minutes late without prior notice, the scheduled appointment will be canceled or rescheduled. A late or cancellation fee will not apply.

6. Fees and Payment for Services Rendered

 

      • Notarization Fees. All Notarization Fees are determined by state law. For the State of New Jersey, the notarization fee shall not exceed $2.50 per document notarized. For the State of New York, the notarization fee shall not exceed $2.00 per signature notarized. The Notarization Fee that the Company will charge for each notarization in the State of New Jersey will be $2.50 per document notarized. The Notarization Fee that the Company will charge for each notarization in the State of New York will be $2.00 per signature notarized. That being said, the Notarization Fee the Company will charge you is hereby non-negotiable. Please note that the Notarization Fee is a different and a separate fee from other service fees and may be added to the total cost for services rendered.
      • Other Service Fees. Additional fees for services rendered may apply. Such costs may include and are not limited to an Administration Fee, a Travel Fee, a Printing Fee, a Scanning Fee, and other related services, which will be clearly communicated before any services are rendered.
      • Payment Terms. Payment is due at the time of service unless otherwise agreed upon in writing. The Company accepts physical legal tender, debit card, and credit card cash payments. The Company will not accept checks or money orders unless you, the Client, are a Signing Service Entity, Loan/Mortgage Entity, Title Entity, Real Estate Entity, Legal Entity, Government Entity, or some other legally registered Entity within the United States of America. Nonetheless, whether you, the Client, are an Entity or not an Entity, the Company shall hold the right to choose one or more preferred payment methods by which it shall be paid for services rendered.
      • Refund Policy. Once services are rendered to you, the fees for said services rendered shall be non-refundable. Refunds shall not be issued to you for any payments of services made beforehand for cancellations, no-shows, or for any previous or current errors resulting from incorrect or incomplete information provided by you, the Client.

7. Privacy and Confidentiality

 

      • Information Notice. The Company is committed to protecting your privacy and your identity, as well as maintaining the confidentiality of all documents and information provided. Personal information collected during the course of each notarization appointment meeting is kept confidential in compliance with applicable state and federal laws. The Company will not share your information with third parties except as required by law or with your explicit consent.

8. Limitation of Liability

 

      • Company Not Liable. Shane Duncan Notarial Services, along with its Representative, are hereby not liable for any indirect, incidental, or consequential damages that may arise from the use of Company services. In no event shall the Company’s total liability to you, the Client, exceed the fees paid by you for such services rendered and provided to you. The Company is hereby not responsible for the legality, validity, or enforceability of any document notarized by said Company, nor for any consequences resulting from improper use or misuse of notarized documents.

9. Disclaimers

 

      • Non-Attorney Disclaimer. The Company and its Representative are not attorneys and do not provide legal advice. You, the Client, seeking legal advice should consult with a licensed attorney. Shane Duncan and the Company’s primary duty is to act solely as an impartial witness to the signing of documents and verify the identity of Signers as required by law.
      • Document Validity Disclaimer. The Company and its Representative make no representations or warranties regarding the validity, enforceability, or legal effectiveness of documents notarized. The Company’s notarial services only verify identity and compliance with state laws concerning notarization.

10. Governing Law and Jurisdiction

 

      • State Law. These Terms are governed by and construed in accordance with the laws of the State of New Jersey and the State of New York. Any and all legal disputes within the State of New Jersey arising from these Terms or the use of Company services shall be resolved in the courts of Essex County, New Jersey. Likewise, any and all legal disputes within the State of New York arising from these Terms or the use of Company services shall be resolved in the courts of New York County, New York.

11. Changes to Terms

 

      • Right to Modify. The Company and its Representative reserve the right to modify these Terms at any time. Any changes will be effective immediately upon the posting on the Company Website. The Company and its Representative will periodically make material changes to these Terms, and when such changes are made, the Company and its Representative will provide you with the updated version of these Terms and make it known to you by modifying the “Effective Date at the top of said Terms of Service. The Company and its Representative encourage you to review these Terms periodically to stay informed about how said Company and Representative on how said parties intend to do business with you. By continuing to use the Company’s services after changes are posted, you hereby agree to be bound by the updated Terms.
